Trademark Ireland – Earthsong, Magic Turkeys and Jimmy Lee’s Juke Joint Tradmark Applications

It has been a week since we did a snoop through the latest Irish Trademark Applications filed! People often ask me why they need a solicitor or Trademark Agent to register a trademark, and I always tell them ‘You don’t’, but if you don’t, there’s a good chance you’ll do something wrong, most likely either (1) Registering your Trademark in the wrong class, or (2) Applying for a Trademark that has no chance of being registered. That happens a lot, and there’s a few examples in the below (though I wont name names). This is basically just throwing away money, because it’s going to cost you €244 (€70 up front and €177 on registration) for a trademark in just one class, and if it’s the wrong class, it’s no real use to you, or else it will cost you €70 per class per trademark for the Patents Office to send you back a standard letter saying that your application is ‘open to objection’ on the relative grounds under the Trademark Act 1996 Because I’m sound, I’ve actually emailed a few of the below to tell them they have tried to either register in the wrong class and/or applied to trademarks that will not be granted.
